Mackenzie and Phillips define the concept as follows: the process of acquiring title to land by dispossessing the previous holder and occupying the land until his right to recover it is time-barred.[1] As cases such as Powell v McFarland [1977][2] and Buckingham County Council v Moran [1990][3] confirm, adverse possession requires the co-existence and proof of three elements in regards to the occupation of the property in question.. These elements are physical, mental and temporal. Generally speaking, this means that any party seeking to claim the property occupy it exclusively (preventing the occupation of others) and openly to the world at large just as if it were their own. In simple terms an adverse possessor is nothing more than a trespasser, which is itself a tort against the owner of the property, although according to ancient law, if he or she can perpetrate the tort unchallenged for long enough they may be rewarded by being allowed to acquire ownership of the property in question without the knowledge or consent of the rightful landowner. In almost all other circumstances the law has a word for property which is removed from its owner without consent and that word is theft. Perhaps it comes as little surprise therefore that in recent times the historical anomaly of adverse possession has fallen under critical review.[7] In recent times Parliament has substantially improved the position of a registered landowner without actually abolishing the doctrine of adverse possession. Impetus for recent legislative reform came in part from the Law Commission and its influential report Land Registration for the Twenty-First Century: A Conveyancing Revolution (2001)[8]. The report proposed new rules for the adverse possession of registered land which, it is submitted, effectively neutered the rights of squatters. Produced in response to the 2001 Law Commission report, the Land Registration Act 2002[9] now stipulates that where land is registered, if an adverse possessor wishes to take an interest in land he must apply to be registered as owner after a minimum period of 10 years of adverse possession. Significantly the Land Registry must then give notice to the true owner of this application. This procedure offers the landowner a p eriod of time 65 business days to object to the adverse possession.. Once objection has been made the true owner will usually have a further two years in which to effect the eviction of the adverse possessor. It is submitted that this legislative reform effectively drives a knife into the heart of adverse possession by preventing the removal of a land ownerà ¢Ã¢â€š ¬Ã¢â€ž ¢s right to property without their prior knowledge. It could be argued however that this policy fails to give proper emphasis to the contended benefits of adverse possession. In terms of a utilitarian socio-economic analysis one could assert that given that land is a finite commodity it should be used in such a way as to produce the maximum societal benefit. If a landowner has ignored property for such a long period of time, perhaps it is contrary to social justice to deny another party, who has committed himself to the land, its use and enjoyment. In the recent cases of Beaulane Properties Limited v Palmer [2005][10] the law of adverse possession received further, and possibly fatal, body blows.. The High Court ruled that the law of adverse possession in relation to registered land is not compatible with the Human Rights Act 1998[11] and Article 1 of the First Protocol of the European Convention on Human Rights[12], which provides for the right to peaceful enjoyment of possessions. This decision is consonant with another recent case before the European Court of Human Rights JA Pye (Oxford) Land Ltd v United Kingdom [2005][13], it was held (although only by a 4:3 majority) that the doctrine of adverse possession was indeed a violation of Article 1 of the First Protocol to the Convention. Moreover, the Court of Human Rights found that it was disproportionate for the true owner both to lose his land and to receive no compensation for it and that adverse possession interfered with the fair balance between the public interest and the true owners right to the peaceful enjoyment of his posse ssions.[14] The decision was appealed by the UK Government to the Grand Chamber of the Court Europes highest court, in November 2006. At the time of writing (24 February 2007) this ruling is still awaited.[15] It is submitted that the Grand Chamber is likely to endorse the ruling of the Court of Human Rights given that to do otherwise would necessitate jurisprudential gymnastics around the fundamental right enshrined in Article 1 of the First Protocol to the Convention. The Chivalric code is a clutter of rules that contradict each other and challenge normal human behavior. In the poem, Sir Gawain and the Green Knight, Sir Gawain proves to be a hero because he continually struggles against his human flaws to act in a heroic manner. Sir Gawain is acknowledged as a chivalric human because he is a courageous man who perseveres through difficult events and faces both human temptation and terror. Throughout Sir Gawain and the Green Knight, Gawain constantly battles to uphold the chivalric code, and in the end one can determine that Gawain did in fact uphold the chivalric code. To begin, Gawain upholds the law to be a courageous man in all circumstances. Near the end of the poem Gawain reaches the Green Knight’s castle to uphold his promise that they made a year and a day before. When Gawain arrives, he and the knight begin conversation and form an agreement to follow through with the terms. As the Green Knight describes what he shall do, Gawain says, â€Å"Never fear†¦ I’ll stand still and allow you to work as you like and not oppose/ you here† (91-95). At this point within the poem, Gawain has done everything to follow the code of chivalry. True bravery and courage is not found in many men, but Gawain is able to conquer this obstacle and prove that he is brave. In this instance, Gawain is allowing the knight to do as he pleases, which is to cut off his head. This demonstrates that he is a fearless man awaiting his death. Additionally, he does not choose to resist the punishment and run for his life, he takes in the punishment because he has the strength to accept his fate. Many men in this situation could not demonstrate this action, allowing the reader to conclude that Gawain has a strong sense of bravery, which is an important and crucial characteristic needed to uphold the chivalric code. As the story progresses, so does Gawain following and upholding the Chivalric code. The code, furthermore, includes such as acts of honor and noble behavior towards women. After the Green Knight has given his punishment to Gawain, he speaks words of truth to him saying, â€Å"A man who’s true to his word should have nothing to fear† (195-196). The Knight know that Gawain did nothing wrong the first two days, because he returned what he had received. Since he did not try to take her seductive kisses to the next level while being chaste towards the mistress, shows that he respects women. Respect and love towards women is an important contribution to the chivalric code. Furthermore, the demonstration of returning what was received for the two of the days shows that Sir Gawain was an honorable man to his host, by staying true to his vows exchanged three days earlier. Overall, Sir Gawain is shown to maintain the chivalric code by following four critical laws within the code of chivalry, yet still struggling with his many human weaknesses throughout the course of his journey. Despite the fact that Gawain upheld most of the chivalric code, some may think that he failed to uphold the code because of human mistakes. As the story begins, the Green Knight comes inside the castle, gets his head sliced off and then is miraculously fine, and he walks out telling Sir Gawain to find him in a year and a day. This series of events exemplifies to Gawain that he, himself, is not immortal and he should fear for his own life. When Gawain finally arrives at the Knight’s castle on the dreadful day, the knight explains, â€Å" But you have lacked a little, sir; you were less that loyal;/ But since it was not the sash itself or lust/ But because you loved your life, I blame you less† (207-209). All humans have, in some way, a in fear of death. This was the feeling that overcomes Sir Gawain, causing him to keep the sash that was given to him on the third day by the mistress. This action caused Gawain to fail to uphold the chivalric code because he was disloyal to the host. No other knight would be chivalrous enough to pass up a chance to save his life; each one is human which means they ultimately fear their own death. In the end, some would consider Gawain a failure, but in logical terms it was an opportunity too difficult to pass up by any human, showing that human flaws have interfered with Gawain’s journey to uphold the chivalric code. The knight agrees with this and understands that even though Gawain should uphold the code, he has to go through some loopholes. This understanding by the Green Knight later comes about in the conversation between Sir Gawain and the Green Knight, the Knight states, â€Å"You are the finest man that ever walked this earth†¦ so Gawain indeed stands ut above all other Knights† (204-206). Even though Gawain has showed disloyalty to the Knight, or at the time his host, the Green Knight is still able to state that he is a heroic knight. Gawain is considered one of the greatest knights, because he knows that he is only making mistakes due to human flaws in his judgments, which difficult to overcome. But the Knight knows that he has the ability to reco gnize his mistakes and fix them. Overall, this shows that Gawain is trusted and trusted not to repeat his mistakes, revealing him to be chivalrous by then end of the poem. In conclusion, some may think that Gawain was not able to uphold the Chivalric code, but this is a false accusation, because he struggled due to his human flaws that would be impossible to overcome for any living being. Sir Gawain is able to uphold the chivalric code by conquering difficult tasks while following the rulebook. The Chivalric Code is a complex system that goes against many human flaws and behaviors. Gawain stays courageous, honorable and gentlemen-like through out his journey, even tough he has many battles with temptation and fear. Gawain tries with extreme patience to overcome his errors, but sometimes fails to do so, which shows that he is only human and that everyone makes mistakes but they have the ability to fix them. As Sir Gawain and The Green Knight ends, the reader concludes that even though Gawain did have some failures in meeting all of the exact laws the chivalric code, he is still able to uphold a majority the code of chivalry with prominence and pride. But what is it exactly that is really wrong with the environment.. Well, its the people who need to get around using things such as cars that give off pollutants into our atmosphere. The wants and needs of society grow mainly because of population expansion and a growing desire for a more comfortable life. But is the U.S. only dealing with this? Beijing has been proven to be the worlds smoggiest city. The air has diminished so severely that Premier Zhu Rongii and other top leaders have made major cleanup measures. Tiny little vans called an Miandi have been one of the major causes of poor air quality. Although they call for less then 2% of the more then 1.4 million vehicles, they are the sources of 8-10% of the pollution because of their auto gases. T he other factors of pollution in Beijing are the restaurants and businesses that use coal to fuel their stoves (Beijing). However, the question is not what caused the pollution but how we will stop it. There are 2 good answers for Beijing. One is to convert the coal burning stoves into stoves that use cleaner fuels. The second is a company that is trying to crack down on pollution called Capital Steel. Capital Steel has been a long time target of environmentalists and by 2003 they plan to spend $100 million on pollution prevention (Beijing). On the other hand, in the US the Environmental Protection Agency has been enforcing air pollution standards on S.U.V.s, pickups, and mini-vans. The effects of these standards are the rising costs of motor vehicles. The EPA had estimated that these standards will increase the cost of cars on average $100 and trucks about $200 (Trucks). There is a problem however, with creating cars that give off non pollutant materials. This gasoline additive, MTBE, has seeped through into near by wells and has forced and has forced them to close. The result of this is that millions of dollars have been spent in the clean up costs( Gasoline). In conclusion, I guess you could agree with me when I say the world we live in is far from perfect. Things will be proven to be harmful and there will be ways to save us at the mere cost of millions. The reason that air pollution is important is that it shows not only the U.S. is cracking down on pollution prevention but the rest of the world is too, not to mention the hundreds of millions of dollars that are being spent because of the tragedy of the commons. Hope is the faith in powers beyond one’s control. Without hope people would simply give up when faced with struggle. Dickinson awes at hope and what it can do. In the poem hope is shown as an animate thing, a bird. The imagery of hope being a bird with feathers gives the reader an image that hope can take flight (Pottebaum). By the 1860s, she very rarely left Amrherst , her family home (Kirk). Miss Dickinson never married and it was suggested that she may have experienced unrequited love (Kirk). This could suggest that these events of loss and isolation helped contribute to the imagery she would later use in her writings. It is the pain and loss of those we love that strikes the deepest. In giving these emotions the attributes of storms â€Å"that could abash the little bird† (7) Miss Dickinson paints an image of our lives as we face events that we cannot control. Hope is given feathers that can touch our souls and bring us out of our despair with its sweet song (Pottebaum). It also brings forth the image that hope is a delicate thing that can still sing, even during the fiercest of events (Brantley). It dwells in each of us, and this is projected in the most direct way by simply stating† that perches in the soul† (2). This statement speaks to everyman that hope resides inside the soul; but one must listen for its song. It is for this reason that I have been drawn to this poem. All of us face events and challenges that can seem overwhelming, but with hope we find a way to endure. As Miss Dickinson states we must listen and embrace this hope. Hope is in everyone, and is the light that drives people out of the darkness. It is â€Å"sweetest in the gale is heard† (5), this is saying that hope is contagious. Once it is â€Å"heard† it can be passed from one person to another. Dickinson portrays hope as a burning desire to make it through the â€Å"storm† (6). This melody of hope can carry us through difficult times without asking for a crumb. She explores the selflessness of hope. When it is not needed it waits within one. It never leaves; hope is always there to shine through the dark when one decides it is time to call upon it. Hope never asks for anything in return, â€Å"Yet, never, in extremity, It asked a crumb of me. † (11-12). Dickinson is saying that hope is the light in one’s soul; it is the good in us (Brantley). I believe this image is an encouragement to live life knowing that hope is there in the soul asking for nothing but the opportunity to sing. The description of the† chilliest lands and strangest seas† (9-10), brings forth both an interruption of the possibility of loss or as a prompt to encourage us to engage life. I see these simple words as both negative and positive. Dickinson accomplishes this theme with the use of voice. She uses short, yet powerful words to create a tone of simplicity. She intends these words to strike, to hit home. Dickinson wants these words to create an emotional experience. She wants the reader to remember all the times that hope was there for them, guided them, and helped them cross to the other side of the storm. Her wording is informal; this creates a sense of familiarity between the reader and the thing of hope (Brantley). Her tone is humbled and appreciative; she speaks as if she owes the little bird of hope a great deal. She refers to hope sweetly as if reminiscing about a fond memory. Yet, hope is not a thing that comes out in times of happiness; it appears in times of despair. It is a friend, a guiding light, or to Dickinson a little bird (Pottebaum). Whenever she has needed it, her friend has appeared for her and this she is grateful. On a simplistic view, â€Å"chilliest land† (9) can seem cold and harsh, but if you never venture and explore do you truly live? The words strangest sea could be both literal and emotional; Miss Dickinson could be exploring love or moving away from the comforts of family (Brantley). It is compelling that such simple, concise words can hold such meaning when comparing to her life or ours. These universal concepts engage us to look at our own lives and view ourselves in more simple terms. Life can be full of tribulations, it is these times we must look for the warmth and bear the sore of the storm. Miss Dickinson brings to her readers’ visual concepts in the form of the feathers implying that hope is a bird. The audible suggestion is presented in the form of the hearing and listening for the song of hope. She also in her own concise way brings in the physical feeling of cold and unfamiliar in her descriptions in the â€Å"chillest lands and strangest seas† (9-10). This writing could be read quickly and dismissed so easily if one did not take time to exam with depth and feeling, these simple words imply. These thoughts are so concise, yet universal. We all will face pain and loss at some time during our lives. It is from within ourselves, that we draw hope and strength to persevere. This image which presents hope as a feathered bird, the most fragile of things; yet it survives the storms life brings this suggests unsaid we can, also. This depth of thought can be brought forth by reading and contemplating the words carefully with introspection of one’s own challenges. Pain, loss and hope are universal; despair comes to those who stop listening for the song of hope. Hope is there but we must be open to it. Miss Dickinson was a prolific writer (Brantley). Following her death in 1886, her family found approximately 1800 poems she had placed in volumes she had carefully, and I believe, loving assembled her handwritten writings she had devoted her life to her poetry (Kirk). It is an amazing testament of her views, as shown so simply in this work, of the complicated emotions one faces in life. Dickinson chose to write this poem in a way that made you think about life. She used simplistic words that held deeper meaning with the underlying metaphors between human nature, hope, and a bird itself. Life is much this way, things seem clear on the surface but as you reach the root of things one realizes that life is much more complex. Objectives Literature Review Brief History Prior to the development of coal in the mid 19th century, all energy used was renewable, with the primary sources being human labor, animal power in the form of oxen, mules, and horses, water power for mill power, wind for grinding grain, and firewood. By 1873, concerns of running out of coal prompted experiments with using solar energy.  Development of solar engines continued until the outbreak of World War I. The eventual importance of solar energy, though, was recognized in a 1911 Scientific American article: in the far distant future, natural fuels having been exhausted [solar power] will remain as the only means of existence of the human race. In the 1970s environmentalists promoted the development of alternative energy both as a replacement for the eventual depletion of oil, as well as for an escape from dependence on oil, and the first wind turbines appeared. Solar had always been used for heating and cooling, but solar panels were too costly to build solar farms until 1980.  The theory of peak oil was published in 1956. By 2008 renewable energy had ceased being an alternative, and more capacity of renewable energy was added than other sources in both the United States and in Europe. Renewable energy is becoming more and more prevalent around the world, but it is still not the dominant energy resource.  Renewable energy is derived from natural processes that are replenished constantly. In its various forms, it derives directly from the sun, or from heat generated deep within the earth. Included in the definition is electricity and heat generated from solar, wind, ocean, hydropower, biomass, geothermal resources, and biofuels and hydrogen derived from renewable resources. Renewable Energy as a replacement for Conventional Fuel Renewable energy replaces conventional fuels in four distinct areas:  electricity generation,  hot water/space heating,  motor fuels, and rural (off-grid) energy services: Power generation. Renewable energy provides 19% of electricity generation worldwide. Renewable power generators are spread across many countries, and wind power alone already provides a significant share of electricity in some areas: for example, 14% in the U.S. state of Iowa, 40% in the northern German state of Schleswig-Holstein, and 20% in Denmark. Some countries get most of their power from renewables, including Iceland (100%), Norway (98%), Brazil (86%), Austria (62%), New Zealand (65%), and Sweden (54%). Heating.  Solar hot water  makes an important contribution to  renewable heat  in many countries, most notably in China, which now has 70% of the global total (180 GWth). Most of these systems are installed on multi-family apartment buildings and meet a portion of the hot water needs of an estimated 50-60 million households in China. Worldwide, total installed  solar water heating  systems meet a portion of the water heating needs of over 70 million households. The use of biomass for heating continues to grow as well. In Sweden, national use of biomass energy has surpassed that of oil. Direct geothermal for heating is also growing rapidly. Transport fuels. Renewable  biofuels  have contributed to a significant decline in oil consumption in the United States since 2006. The 93 billion liters of biofuels produced worldwide in 2009 displaced the equivalent of an estimated 68 billion liters of gasoline, equal to about 5% of world gasoline production In international public opinion surveys there is strong support for promoting renewable sources such as solar power and wind power, requiring utilities to use more renewable energy (even if this increases the cost), and providing tax incentives to encourage the development and use of such technologies. There is substantial optimism that renewable energy investments will pay off economically in the long term. As a renewable source of free, green energy, technology has found a way of harnessing the suns energy via solar panels which are used either to generate electricity (solar photovoltaics) or to produce heat to warm water (solar thermal). A popular choice in a growing renewable energy market, solar technology doesnt generate greenhouse cases and is environmentally friendly. Biomass Biomass energy is produced from organic materials such as plants and animals, but the energy that is produced in this fashion is originally provided by the sun.   For example, plants absorb the suns energy through a process called photosynthesizes.   This energy is then passed on through the organism that eats the plant, creating biomass energy.   The most common forms used to generate biomass energy are wood, crops, manure and some rubbish. When these substances are burned, they give off energy as heat.   For example, if you have a  wood fuelled heating, you are generating renewable biomass energy.   This is not the only method of generating biomass energy; you can also create biomass energy by converting these substances into methane gases, ethanol and biodiesel fuels which can be translated more easily into our current methods of energy use. Geothermal Geothermal energy comes from the original Greek word Geo which means sun. Geothermal energy is derived from the heat that is given off by the Earth.   For example, steam energy or hot water that is generated by the Earth can be used to generate energy.   It is considered to be a renewable source of energy as the water in the Earth is replenished by regular rainfall and the heat used is regularly produced by the planet. Hydro Power Hydro energy is derived from the movement of water.   One form of  hydro power  is generated through the movement of water through turbines, such as water running through turbines in a Dam.   Hydro power is considered a renewable energy source as the water is continuously cycled back through the plant or into nature. Biofuels Biofuels are a form of renewable energy derived from burning plant or animal substances, otherwise called combustion. One of the challenges to biofuels has been that it is not easily transferred into a liquid form which is the primary method used to fuel most cars and homes. Two of the most common strategies that are seed to produce biofuels includes: growing crops to produce ethanol and growing plants that produce biofuel oils. While these methods are effective sources of renewable energy, they are challenging to produce and maintain on a large scale. The basic feature of renewable energy is that it has the capacity to be regenerated and, as such, is virtually inexhaustible, besides being environmentally friendly. These are the two major properties that distinguish it from traditional energy sources. In recent years, these two features have pushed renewable energies to the forefront since, if current fossil fuel consumption rates are maintained, they would only be able to meet our energy needs for a few more decades before running out. The damage to the environment, on the other hand, caused by the burning of fossil fuels and the resulting climate changes, force us to consider alternative energy sources if we want to preserve the planet and guarantee the well-being of future generations. Advantages The advantages of renewable energy over traditional energy sources are many and are receiving ever greater recognition. Technological progress in recent years has contributed to making renewable energy ever cheaper and efficient in generating electricity. The main advantages of renewable energies are: They are inexhaustible, whereas fossil fuels are limited. They have less of an environmental impact than fossil fuel energy sources (coal, oil and gas), since they do not produce carbon dioxide or other greenhouse gases. They are less of a risk than nuclear energy. They provide energy independence to a country, given that their use does not depend on the import of fossil fuels (which only exist in certain regions of the world). They allow a country to develop certain areas within its borders. Disadvantages It is easy to recognise the environmental advantages of utilising the alternative and renewable forms of energy but we must also be aware of the disadvantages. One disadvantage with renewable energy is that it is difficult to generate the quantities of electricity that are as large as those produced by traditional fossil fuel generators. This may mean that we need to reduce the amount of energy we use or simply build more energy facilities. It also indicates that the best solution to our energy problems may be to have a balance of many different power sources. Another disadvantage of renewable energy sources is the reliability of supply. Renewable energy often relies on the weather for its source of power. Hydro generators need rain to fill dams to supply flowing water. Wind turbines need wind to turn the blades, and solar collectors need clear skies and sunshine to collect heat and make electricity. When these resources are unavailable so is the capacity to make energy from them. This can be unpredictable and inconsistent. Its Too Expensive Everyone seems to know that federal and state governments have significant financial incentives in place to help promote the adoption of solar power.    Even after these incentives, the average residential solar system costs between $10,000 and $30,000 and for most people, this represents a major capital investment.   As a result, most people stop there and say, I cant afford it.    What they dont know is that there are a number of financing options available to help ease the cost of solar.   For example, a number of solar installers offer  financing programs  , similar to small loan or mortgage, where there is little to no up front cost and finance the balance of the purchase price through a loan.   As a result, the homeowner does not have to come up with cash upfront but can amortize the cost of the solar system over time.   Whats great is that when you factor in a your reduced utility bill from solar and the amortization cost of the panels, this amount is most likely still less than your electric bill without solar power.   So you save immediately and that savings grows over time as electricity rates increase. There are also programs where you can  lease the panels  Ã‚  for little to no up front costs and you pay a small, manageable monthly fee over the term of the lease.   Again, the savings on your electric bill from the solar panels plus this leasing fee is still likely to be less than your current electric bill without solar.   There is also a mechanism called a  power purchase agreement  , which is a great option for larger projects, where the solar installer installs and owns the panels on the roof of your home/building but provides you electricity and simply charges you a flat fee for that electricity over the life of the agreement (typically 15-20 years).   That way you are guaranteed a set rate of electricity over a long period of time (protecting you from annual rises in electricity rates) and there is no up front cost to you. The moral of the story is that there are a lot of options for people to pay for solar panels. Gone are the days where you have to come up with all the money for solar panels up front. There are simply more ways than ever to finance and make the cost of solar work out beneficially for residential and commercial consumers alike. Solar Wont Work in cold climate Another really bad excuse. The average temperature in a climate region does not have an effect on solar panels.   In fact, solar panels are actually slightly more efficient at producing electricity in cold temperatures. The critical factor for solar panels is a concept called solar isolation which is the amount of sunlight that the solar cells receive. Obviously, the more the better so even if you live in a colder climate that is further north and receive ample amounts of sunlight, solar should work just fine for you. Remember, Germany, is which is farther north than just about any state in the U.S., is the world leader in solar photovoltaic energy with over 9,000 Megawatts.   Thats almost enough to cover the roofs of 2 million U.S. houses!    So dont worry if you live in a cold climate, just make sure that you receive plenty of sunshine. No Power if its cloudy A reasonable concern, but again, not a good reason to avoid solar power.   As stated above, its not temperature that affects the performance of solar panels, rather it is the amount sunlight received.   And even in the sunniest of locations, there are going to be days where there is cloud cover or rain (not to mentioned nightfall) and your solar panels performance may be compromised.   Not to worryà ¢Ã¢â€š ¬Ã‚ ¦you will not be left in the dark. Residential and commercial solar panels these days are almost always connected to the utility gridà ¢Ã¢â€š ¬Ã‚ ¦it is called a grid-tie.   So, while your solar panels are exposed to the sun, the electricity they produce powers your house or building.   But when it is cloudy or nightfall, you will still be able to draw power for your home or building because you remain connected to the electrical grid. Another cool concept is what is called net metering.   In states that allow net metering, if your solar panels produce more electricity in a day than you are consuming, that extra electricity is fed back into the electric grid and can actually spin your electric meter backward.   As a result, at the end of the month, the electric company will take into account the electricity that you fed back in to the grid through your solar power system and you will only pay for the net amount of electricity that you consume.
